Britains largest civil service union, the 283,000 strong Public and Commercial Services Union (PCS), was today served with High Court papers seeking to overturn decisions of the moderate-led National Executive Committee (NEC). The legal proceedings follow last weeks stormy meeting, when the newly elected NEC accepted counsels opinion declaring the election of Mark Serwotka as unlawful, and therefore null and void.
The High Court proceedings have been issued by Mr Serwotka against both the PCS and Barry Reamsbottom, who now remains in post until his retirement in April 2004.
Speaking today Mr Reamsbottom was clear that the PCS would vigorously defend itself and its decision in the face of the legal challenge. He went on to say: "This is the last twitch of the old hard left dinosaur. A brand new Executive was democratically elected only last month, and Mr Serwotka appears unable to accept that members rejected his supporters attempts to run the union.
"I am astonished that Mr Serwotka has chosen to attack me personally in the issuing of these papers. I wont be cowed into backing off from defending the union against this legal onslaught. Mark Serwotka should reconsider his damaging legal action in the face of the NECs decision that his election was simply unlawful.
"I want to reassure all our members that PCS will continue to represent them, and that we will not let them down."
